GAMR – Privacy Policy

The GAMR Platform (the "Platform") is owned and operated by GAMR, LLC ("GAMR," "we," "our," or "us"). This Privacy Policy, which is incorporated into and governed by the GAMR Terms of Use, provides information on how we process, disclose, and safeguard your information when you access or use the Platform, which includes the website, software, applications, user accounts, and features. Any capitalized but undefined terms in this Privacy Policy will have the meanings set out in the GAMR Terms of Use.

BY ACCESSING OR USING THE PLATFORM, YOU AGREE TO THE GAMR TERMS OF USE AND THIS PRIVACY POLICY. IF YOU ARE UNABLE TO AGREE OR DO NOT AGREE TO ALL OF THE GAMR TERMS OF USE AND THIS PRIVACY POLICY, THEN PLEASE DO NOT ACCESS OR USE THE PLATFORM.

1. Information We Collect, Receive, and Create

The Platform's Purpose is specified in the GAMR Terms of Use. Given the Platform's Purpose, any User Content that you Post to the Platform becomes available to the public through the Platform. User Content that is removed or deleted may still remain viewable. Please do not Post any User Content, either to the Platform or with us, that is sensitive, private information or that you do not wish to share publicly.

GAMR does not sell your personal data or personal information.

In furtherance of the Platform's Purpose, GAMR may collect, receive, and create information and data in accordance with applicable data protection laws and the legitimate interests that we reasonably determine necessitate the collection, receipt, or creation. With respect to GAMR's operating and provisioning of the Platform, the types of information and data that we may collect, receive, and create generally fall into 4 categories: (a) information you provide in relation to user accounts ("User Account Information"); (b) information you Post through User Content ("User Content"); (c) information obtained through cookies, analytics services, or tracking technologies ("Platform Usage Data"); and (d) aggregated data from user accounts that is not reasonably linkable to identifiable individuals ("Aggregated Data").

2. Cookies & Tracking Technologies

GAMR uses cookies, pixels, analytics tools, and other technologies to measure and understand Platform usage, to provision certain Platform features, and to personalize and enhance your experience with the Platform.

2.1 What Cookies Are

Cookies are small text files placed on your device when you visit a website. They help recognize your browser, remember preferences, and analyze site activity.

2.2 Types of Cookies We Use

Essential Cookies: Certain cookies are essential and required for core Platform operations and functionality, such as logging into your user account, maintaining user account sessions, and ensuring site security.

Analytics Cookies: Analytics cookies and third-party tracking technologies, including Google Analytics, are used by GAMR and the Platform to measure and analyze user behavior, traffic patterns, and Platform operations, which may include: visitor counts, time spent on Platform pages, navigation behavior, and referral sources. Analytics cookies help us improve the Platform but do not identify you personally.

Third-Party Cookies: In relation to the banner advertisements and third-party websites, including Amazon Associates, that may be displayed on the Platform, third-party cookies may be set and used by such third-parties according to their own privacy policies. These cookies may be used by such third parties for their own purposes that may include: recommending video game products and related goods, tracking clicks on such third-party links, measuring the effectiveness and performance of their advertisements, and assessing your eligibility for their advertisements.

Preference Cookies: Preference cookies are used to personalize Platform experiences, settings such as theme or display preferences (if applicable).

2.3 Cookie Choices

You have the right to decide whether to accept or refuse cookies, and can manage cookies through your browser settings. However, disabling or blocking certain cookies may adversely affect Platform access and functionality. You may also opt out of certain tracking technologies, including Google Analytics, with browser add-ons. Please refer to your browser's 'help' button (or similar) to learn more about how you can do this.

Some regions (e.g., the EU/UK) may require additional cookie consent options. GAMR may provide region-specific banners where required.

3. How We Share Information

We may share your information with GAMR related companies. The purposes for sharing may include assistance with our operation, improvement, and enhancement of the Platform as well as targeted advertising. We may also share your information with third-party service providers that may include:

  • Hosting providers like Replit, Inc. and Google LLC, that provide managed development and hosting services that GAMR uses to operate and provision the Platform;
  • Analytics service providers like Google LLC that provisions Google Analytics, that GAMR uses to collect usage data and statistics regarding user interactions the Platform;
  • Email delivery platform providers like Google LLC that provisions Gmail, that GAMR uses for internal emails and to facilitate interactions with users;
  • Advertising service providers like Google LLC that provisions Google Ad Manager, that GAMR uses to facilitate ad services and track ad performance.

GAMR's policy is to maintain contracts with all third parties with which it shares data and information and to restrict their access to it except as needed to perform their tasks (other than law enforcement where such sharing is determined by applicable law). GAMR may disclose information and data in order to comply with legal obligations, respond to court orders or government requests, and protect the rights and safety of GAMR, users, or the public.

4. Data Security

We use commercially reasonable administrative, technical, and organizational measures that are designed to protect the Platform and your data from unauthorized access, loss, misuse, or alteration. Among these are industry-standard security practices to protect the Platform from exploitation that leverage infrastructure to prevent and detect intrusions; encrypted transmission of data using HTTPS, commercially reasonable access controls and authentication mechanisms, and ongoing platform security reviews and updates.

Further, we practice data minimization, including through one-way encryption of user account passwords using industry-standard encryption and hashing techniques, to limit the data to which GAMR may have in its possession.

While we take reasonable steps to protect your information, no method of transmission over the Internet or method of electronic storage is completely secure. Therefore, we cannot guarantee absolute security. You acknowledge and accept these risks when using the Platform.

You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your user account.

5. Applicable Data Protection Laws and Regulations; Your Rights and Choices

To the extent any of your information or data Posted to the Platform or with us includes personal data, you will at all times be deemed the data controller and will be responsible for compliance with your obligations as data controller under applicable data protection laws, in particular for justification of and liability for any such Posting of personal data.

Many privacy laws and regulations afford individuals specific rights. If you are a resident of jurisdiction subject to privacy laws and regulations, you may have rights to:

  • Withdraw consent to processing of your personal information,
  • Access the information we collect, process, and store about you,
  • Request corrections,
  • Request deletion of your account or data, and
  • Opt out of GAMR marketing communications.

You may be required to verify your identity before we can fulfill any such related request. Please note that the exercise of such rights may result in the loss of access to the Platform and your user account, and we may retain certain information to the extent permissible by law.

6. Children's Privacy

The GAMR Terms of Use establish minimum age eligibility requirements. We do not knowingly collect information about or from children under the age of 13. We reserve the right to remove any information or data at any time if we discover that any such information or data is of or Posted from someone that does not meet the minimum age eligibility requirements. We reserve the right to remove any user account at any time if we discover that any such user account belongs to or is used by someone that does not meet the minimum age eligibility requirements.

7. International Users

By using the Platform from outside the United States, you consent to the transfer of your information to, and processing and storage of your information in, the United States, where data protection laws may differ from your region. As the data controller of such information, you represent and warrant that you have the authority, rights, or permissions to transfer such information, including through Posting to the Platform and with us, in relation to your use of the Platform and in accordance with these Terms.

8. Changes to This Privacy Policy

We reserve the right to update this Privacy Policy from time to time by posting the revised Privacy Policy on the Platform. Changes will take effect on the "Last Updated" date. Your continued access to or use of the Platform or user account after updates constitutes your acceptance of the then current Privacy Policy.
