GAMR – DMCA Takedown Policy

GAMR, LLC ("GAMR," "we," "our," or "us") respects the intellectual property rights of others and expects users of our Service to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), we will respond to valid notices of alleged copyright infringement that comply with the law.

This policy explains how copyright owners may report infringement and how users may file counter-notices.

1. Reporting Copyright Infringement (DMCA Takedown Notices)

If you believe that content available on GAMR infringes your copyright, you may submit a DMCA Takedown Notice. To be valid, your notice must include all of the following information (as required by 17 U.S.C. § 512):

  • Your physical or electronic signature.
  • Identification of the copyrighted work you believe has been infringed, or a representative list if multiple works are involved.
  • Identification of the infringing material you want removed, including the exact URL or location of the content on GAMR.
  • Your contact information, including name, mailing address, telephone number, and email address.
  • A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.

Incomplete notices may be rejected.

2. What Happens After We Receive a Valid Notice

Upon receiving a valid DMCA Takedown Notice:

  • We will remove or disable access to the allegedly infringing material.
  • We will notify the user who posted the content.
  • We may terminate accounts of repeat infringers in appropriate circumstances.

We reserve the right to post or share redacted versions of DMCA notices in transparency reports or with third-party databases (this is common industry practice).

3. Counter-Notification (If You Believe Your Content Was Removed by Mistake)

If you believe content you posted was removed or disabled as a result of mistake or misidentification, you may submit a DMCA Counter-Notification.

Your counter-notification must include:

  • Your physical or electronic signature.
  • Identification of the material that was removed or disabled and its original location.
  • A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled due to mistake or misidentification.
  • Your name, mailing address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the federal courts in the State of California, and that you will accept service of process from the person who filed the original DMCA notice.

4. What Happens After We Receive a Valid Counter-Notification

If we receive a valid counter-notification:

  • We will forward it to the original complaining party.
  • If the complainant does not file a court action seeking an injunction within 10 business days, we may restore the removed content.
  • We are not obligated to restore content in all circumstances—especially if it violates our Terms of Service or Community Guidelines.

5. Repeat Infringer Policy

GAMR may terminate user accounts that repeatedly infringe the copyrights of others. Determinations are made at our discretion and may consider:

  • Number of valid DMCA notices received
  • Severity of infringement
  • User history and behavior

6. Misuse of the DMCA

Submitting false or fraudulent DMCA notices or counter-notices can result in legal liability, including damages and attorney's fees. Abuse of the DMCA process may also lead to account suspension or termination.
